This Agreement applies to air only and package tour vacations using Scheduled Air Transportation (“Scheduled Service”) and Public Charter Transportation (“Public Charter Service”). Scheduled Service and Public Charter Service are also referred to interchangeably as “Travel Service”. Certain provisions of this Agreement apply only to one type of service or the other and are specifically identified as such. Please refer to the Tour Inclusions found in your promotional materials for the name of air carrier, type of service, price information, dates of operation, and the origin and destination cities, which information is incorporated herein.


For Public Charter Service Only

China Professional Travel & Tours, Inc. (CPTT), Norcross, Georgia, is the charter operator and the principal responsible to the tour participants for all services and accommodations offered in connection with these tours. For Scheduled Service only, CPTT acts only as the agent of the airlines and other suppliers of services, such airlines and suppliers being responsible for providing such flights, accommodations, and tours, if any. See also section entitled “What Is Tour Operator’s Responsibility?” The payment of the required deposit or any partial or full payment for a reservation for a tour in consideration for the tour inclusions detailed in this brochure shall constitute consent to all provisions of the contract and general information contained herein.


What Does It Cost and Whom Do I Pay?

The cost includes round trip air transportation and other extras as specifically stated in the promotional brochure. All prices were correct when printed. The price, however, is subject to change and should it be increased, you will be given notice as soon as possible, so that you will be aware of any supplemental charge. Supplemental charges of 10% or less of the total tour price do not allow cancellation without penalty. (See “major changes” regarding increases of more than 10%). CPTT reserves the right to reduce published prices at its sole discretion at any time prior to departure on a non-retroactive basis, i.e. for new bookings only. When you buy the trip from a travel agent, make checks and money orders payable to your travel agent, who will in turn make their check payable to “China Professional Travel & Tours". Transportation provided by airlines for Travel Service is subject to all the terms and conditions of the respective airline’s applicable tariff and/or contract of carriage.


Reservations, Deposits and Final Payment

After a reservation has been made, a confirmation of preliminary information will be issued by CPTT. The following deposit policy will apply: TOUR PROGRAMS: U.S. $300 per person. CHINA OR ASIAN DOMESTIC: (full payment is due). All deposits are due within fourteen days of reservation date. Failure to meet the deposit requirement will result in a release of the reservation. Prices are not guaranteed until deposit is paid. Final payment must be received by CPTT forty-five days before the commencement of the tour. Failure to meet the final payment requirement will result in release of the reservation. For travel within 30 days full payment is due at confirmation.


How May I Cancel?

The right to a refund is limited. Notice of cancellation must be in writing. All claims for refunds must be made through the agent from whom the tour has been purchased. A full refund, less U.S.$100 service fee per person for any cancellation received in writing up to thirty days prior to departure, U.S. $300 service charge for any cancellations twenty-nine to sixteen days prior to departure, 50% of the tour cost for cancellations made within fifteen days prior to departure. Please note the day of departure is not included in computing cancellation charges. Absolutely no refunds may be had for any unused features including cancellation insurance. If you are sharing accommodations with one or more individuals, and they cancel and are not replaced, you will be responsible for the additional hotel supplement charge. All claims for refunds must be made through the agent from whom the tour has been purchased, within thirty days after the termination of the tour. The claim must be accompanied by a statement from a local CPTT representative certifying exactly the services not rendered. Voluntary non-usage of hotel accommodations, tour features or services are not refundable, exchangeable for other accommodations, services or tour features. Refunds will not be made for complimentary accommodations and service provided by the airline. Refunds will not be made if passengers change hotels and/or services in route. If it becomes necessary to change features of the tour, any additional expenses will be charged to the tour members on the spot.


What Is Included?

Tour Price :

The tour price includes land arrangements and air transportation costs as a package. The prices are quoted in U.S. dollars and based on tariffs and rates of exchange between U.S. dollars and foreign currencies. All tour prices are based on cash discounted rates and are subject to increase if payments are made by any forms other than cash/check. All prices are subject to change without notice. All foreign airport and other taxes are not included.

Land Arrangements :
bedded room. The single supplement room rate covers all cities on the tour except any involuntary overnight stays which are provided by the airlines. CPTT reserves the right to modify the tour itinerary or eliminate some activities for tours with less than ten participants.

Air Transportation :
Air transportation fares used for the tours are based on valid published fares and their respective fare rules applicable to the tour program. All fares and fare rules are subject to change by the airline. Any fare increase resulted from such change will be added to the tour price and be borne by the passenger. Air transportation within China is provided by domestic Chinese carriers. Airfares are subject to change and any increase in fare will be added to the tour price and be borne by the passenger.

Hotel Accommodations :
Deluxe, first class or other hotels with private bath as specified in the itinerary will be used. Right is reserved to substitute hotels for those specified in the itinerary whenever necessary.
All hotel accommodations are on the basis of two persons sharing a twin-bedded room.

Meals :
As specified in the itinerary (B) Breakfast, (L) Lunch, (D) Dinner. Voluntary non-usage of meals are non-refundable or exchangeable.

Transfers and Site Seeing :
All transfers and site seeing are by motor coach, car or other conveyance. Transfers to and from airports and hotels will be provided only for tour members utilizing the airspace reserved for the group. Site seeing tours are as described in the tour itineraries. Inside China, site seeing is restricted to the site seeing points covered by the tour package price charged by Tour Operators in China. Additional site seeing points not normally covered in the tour package price will incur extra charges on the spot. CPTT reserves the right to assign individual passengers departing from non-designated gateways, and groups falling below minimum requirements of ten passengers, a seat on transportation not necessarily used for the sole purpose of CPTT. Passengers must provide their own transfer to and from the specified hotel when arriving and/or departing on flights other than the ones specified by CPTT for the specific itinerary.

Tour Leaders (Fully Escorted Programs) :
For groups of 10 or higher on fully escorted programs, a tour leader will accompany the group. Other programs and/or any program with less than 10 people, a local English-speaking representative is provided at each city to meet you on arrival and to accompany you until departure for the next city on your tour unless otherwise indicated.

Tips and Taxes :
Hotel taxes are included in the land costs. Airport departure taxes, China/Asian domestic airport taxes and any additional city development/construction fees imposed by the local government are not included in the tour price and will be collected from each participant before departure at each airport or hotel. Tips to restaurant and hotel waiters for meals specified in the itinerary and chambermaids are included. The customary end of the tour gratuity to the tour managers and tip to local guides, drivers and porters are not included.


Tour Price Does Not Include

Meals not specified in the itinerary, optional tours, tour insurance, tips to the tour guides, foreign airport and other taxes, charges for passports, visas, expenses on the United States mainland, laundry, liquor, excess baggage charges, usage of telephones, personal, health, or baggage insurance, items of personal nature and any other items not specifically listed as included.

NOTE :
CPTT will issue or cause to be issued tickets only after full payment has been received. The ticket is valid only for the flight and date shown and is non-endorsable. If for any reason the ticket is not used, the passenger must contact CPTT for exchange or refund, if applicable, in accordance with the rules contained herein.

Can I Obtain Insurance?

Yes, it is suggested. Information on cancellation, trip interruption, health, accident and baggage insurance is available from CPTT.


What Is the Tour Operator’s Responsibility?

We arrange with airlines, hotels, organized transportation companies and other independent firms to provide you with these travel services. Although we take great care in choosing our suppliers, we do not control them and therefore cannot be responsible for their acts or omissions. Travel Services are subject to conditions imposed by these suppliers who may limit their liability by tariffs, contracts and international agreements. Unless we are negligent, we cannot assume responsibility for any claims, losses, damage, loss or delay of baggage or other property or delay, inconvenience, loss of enjoyment, upset, disappointment, distress, frustration, personal injury or property damage resulting from: (a) the act or omission of any party other than CPTT or its employees, including but not limited to any airline, hotel or other supplier of service or third party related to the tour; (b) mechanical breakdowns, government actions, weather and factors beyond our control; (c) cancellation or changes for any reason in the Travel Services offered, subject to the charter rules on “major changes”. CPTT reserves the right to cancel or alter the Travel Services, at its discretion, provided that in the case of an alteration, CPTT will try to substitute comparable services; in the event of a complete cancellation, CPTT’s only liability will be to refund within fourteen days all monies paid. CPTT may not cancel the travel service less than ten days before the scheduled departure except when it’s physically impossible to perform the trip. If the travel service must be canceled less than ten days before departure due to a physical impossibility, notice will be given as soon as possible. CPTT also reserves the right to cancel any group tour when the number of participants falls below two people, a minimum group requirement; (d) a “major change” is (1) a change in the departure or return dates shown in the brochure, (2) a change in the origin or destination city for any flight leg other than a change in order in which the cities are visited, (3) for price increases amounting to more than ten percent. If CPTT learns of a major change ten or more days before departure, it will notify you within seven days, but at least tens days before departure and otherwise as soon as possible. Within seven days after receiving a pre-departure notice of a major change, but in any event no later than departure, you may cancel, and a full refund will be sent within fourteen days thereafter. Upon receiving a post-departure notification of a major change, you may reject the change, and you will be sent, within fourteen days after your scheduled return date, a refund of the portion of your payment allowable to the tour component not provided. All of your rights and remedies hereunder are additional to other rights you may have under law, but acceptance of any refund hereunder constitutes a waiver of all such rights and remedies.

The airline and CPTT also reserve the right to change aircraft type. No refund will be given for such changes. If CPTT or the airline cancels the trip for any other reason including failure to obtain landing rights from foreign governments of the United States you will receive a full refund. CPTT also reserves the right to charge the airline.


Right To Decline Participants

CPTT reserves the right to decline to accept or retain any person as a participant whose health condition makes him or her physically unfit for long trips, in the sole discretion of CPTT. These health conditions include but are not limited to mental illness, heart disease, serious chronic or contagious illness, physical handicaps, pregnancy, senility or other infirmity. CPTT also reserves the right to refuse to retain a participant and require them to withdraw from the tour at such time as it is determined by the tour coordinator, manager, leader or supplier that it is in the best interest of the tour group and/or the tour individual participant. In such cases a proportionate refund will be made consistent with the terms and conditions herein above set forth.


Customer Disclosure Notice

Please read this notice. It constitutes part of your contract for travel- related services

CPTT arranges with airlines, hotels, ground transportation companies and other independent firms to provide travel services. These travel services are not directly supplied by CPTT. CPTT therefore shall not be responsible for breach of contract, failure to comply with any law such as the American Disabilities Act(“ADA”) or any intentional or negligent actions or omissions on the part of such suppliers, which result in any loss, damage, delay, inconvenience or injury to travelers, traveler’s companions, or group members. CPTT shall not be responsible for any injuries, damages or losses caused to any traveler in connection with terrorist activities, social or labor unrest, mechanical or construction failures or difficulties, diseases, local laws, climate conditions, abnormal conditions or developments, or any actions, omissions, or conditions outside of CPTT’s control. The traveler assumes complete and full responsibility for, and hereby releases CPTT from any duty of checking and verifying any and all passport, visa, vaccination, or other entry requirements of each destination, and all safety and security conditions of such destinations, during the length of the proposed travel. For information concerning possible dangers at international destinations, contact the Travel Advisory Section of the U.S. State Department (202) 647-5225. For medical information, call the United States Centers for Disease Control (CDC) (404) 332-4559. By embarking upon your travel, the traveler voluntarily assumes all risks involved in such travel, whether expected or unexpected. The traveler is hereby warned of the above risks as well as the possible travel industry bankruptcies and medical and climactic disruptions, and the possibility that the traveler may be unable to travel as scheduled because of personal emergencies. The traveler is advised to obtain appropriate insurance coverage against these risks: information is available through your travel agent and CPTT regarding travel insurance. Traveler’s payment and/or retention of tickets, reservations or bookings after issuance shall constitute a consent to this disclosure and an agreement on traveler’s part to convey the contents hereto to his or her travel companions or group members.

A valid United States or Canadian passport is required for all tour participants. Visas are required for China and the Asian countries. Nationals from other countries should check with appropriate embassies, their travel agents or airline for visa requirements. It is the ultimate responsibility of the passenger to have proper travel documentation at time of travel. Visa fees are not included in the tour price. CPTT can provide visa services please check with CPTT on rates. CPTT is not responsible for any losses or expenses incurred if passenger does not have a valid passport and/or visa documents at the time of travel.
